Family left homeless after husband allows husband sell family house

Frank Matumbwe, Florence Nakiberu’s husband and the father of her nine children, was granted permission by a court to sell their marital residence. As a result, Florence and her nine children, who lived in Kikungwe B village in Kimanya Kabonera division in Maska city, are now homeless.

Nakiberu claims that although the pair has been married since 1997, problems arose when Matumbwe started expressing plans to sell their joint property, which prompted Nakiberu to ask for help from the police.

“I remained silent when he sold the Kibanja we shared, but I decided to bring the matter up with the LC1 chairman when he wanted to sell the plot where we built our married home. He called, but he wouldn’t go there. I took the complaint to the police, but he refused once more. As a result, the deputy RCC Kateregga Musaazi was tasked with handling it,” Nakiberu stated.

However, after my husband asserted that some of our children did not belong to him, the LC1 chairperson John Kintu presented me with documents on April 18 requesting that I appear in court regarding DNA issues. When I went to court, I discovered further information when I was told to vacate the house and that the husband had sold it.

Nakiberu claims the court processes were unfair, claiming she was forced to sign documents without fully comprehending them by Daniel Bwambale, the senior principal magistrate grade one court, and that she was not given the opportunity to defend her rights.

She says the magistrate even threatened to take her kids away from her if she didn’t comply.

“The court decided in favor of Matumbwe despite my efforts, forcing me to sign documents that sealed our home’s fate. Senior Principal Magistrate Daniel Bwambale granted me a three-month window to vacate our home so that my husband can sell it.”

According to Nakiberu, the couple received the land from her late mother-in-law.

“So, my husband and I put in a lot of work to build the house that he sold.”

Upon being contacted by Nile post, Matumbwe refuted the accusations made against him and insisted that the court adhere to the proper procedure.

Matumbwe refuses to change his position in the face of the rift that has split his family, leaving Nakiberu and her kids to deal with the fallout from his deeds.

Daniel Bwambale, a senior principal magistrate in grade one, refuted the allegations as well, stating that he had translated the paperwork for her before she signed them and that she had accepted them all.

In addition, he said that since Nakiberu and her spouse Matumbe were not legally wed despite having children together, everything he did was legitimate.

Nakiberu and her kids are currently pleading with higher authorities to address the injustice they have experienced.

Residents and village chairman John Kintu expressed their sorrow at the recent events and demanded justice for the family.
